1. Overview

These Terms of Service govern access to and use of all online galleries delivered via Pixieset by Anne Marie Harding (“AMH,” “we,” “us”). By accessing, downloading, or sharing images from a gallery, you agree to these terms.

2. Image Ownership & Copyright

All images remain the exclusive intellectual property of Anne Marie Harding, protected under Canadian copyright law.

• Clients are granted a limited, non-exclusive, non-transferable license for approved use

• Ownership is not transferred under any circumstances unless agreed to in writing
  

3. Usage Rights (Standard License)

Unless otherwise specified in writing:

Permitted Use:

• Personal use (sharing with friends/family)

• Social media posting (with credit where possible)

• Portfolio or non-commercial digital use

Not Permitted Without Written Consent:

• Commercial use (ads, resale, publications, brand campaigns)

• Editing, altering, or applying filters to final images

• Selling or redistributing images
  

4. Credit & Attribution

When sharing publicly, clients are encouraged to credit:
Photo by Anne Marie Harding or tag @amhportfolio (where applicable)

5. Gallery Access & Expiry

• Galleries are hosted via Pixieset and may be available for a limited time (typically 30–90 days)

• Clients are responsible for downloading and backing up files before expiry

• Gallery extensions may be available upon request
  

6. Image Delivery & Edits

• Images are delivered in a curated, edited format consistent with AMH’s artistic style

• Additional edits or retouching may be available at an additional cost

• RAW files are not provided
  

7. Third-Party Sharing

Clients may share images with individuals featured in the gallery for personal use only

If individuals request copies directly (which happens often in your event work), images may be shared at AMH’s discretion under the same usage terms.

8. Model Release & Promotional Use

Unless otherwise agreed:

AMH reserves the right to use images for:

• Portfolio (website, Pixieset, social media)

• Marketing and promotional materials

• Editorial, storytelling, or campaign use

(Aligned with how you’ve leveraged storytelling and UGC in past campaigns )

Clients may request limited-use restrictions in writing prior to delivery.

9. Sensitive Content & Client Representation

AMH respects client comfort and boundaries. However:

• Final selections remain at photographer discretion

• Requests for removal from public use must be submitted in writing

• Content will not be knowingly used in a harmful or misleading way
  

10. Liability

AMH is not liable for:

• Loss of images after gallery expiry

• Unauthorized use by third parties once images are shared publicly

• Platform-related issues (Pixieset outages, downloads, etc.)

By accessing your gallery, you acknowledge and agree to these Terms.
